When an employer hires an employee, they enter into an unwritten contract, but one that is backed by law. Employees have the right to be treated fairly by an employer and not be abused for a variety of reasons. It may be the employer is withholding pay for a deceptive reason, or there is discrimination going on against a protected class. When the employer violates an employees rights, the employee has the option to invoke Employment Law in order to enforce their rights.

Employers are supposed to respect their employees at all times and not abuse their labor. Unfortunately, there are many unscrupulous employers who rely on their employees being ignorant of Employment Law. They prey on their employees, taking advantage of their labor while treating them with contempt. In turn, the employees keep working and accepting the abuse because they don’t know their rights. No employee should be subject to an employer who doesn’t do right by their employees. The simple answer is to quit the job and move on, but this may not be a viable option.

An employee who feels that they are being treated unfairly has the option to take legal action against their employer. It is not always pleasant, and there are no guarantees of a result, but it can serve to right a wrong and settle the issue. It may also teach the employer a hard lesson about proper treatment of employees going forward. Ultimately, the decision to bring the situation to a legal settlement is a tough one, but sometimes the only recourse an employee has to enforce their rights.

Talking to a lawyer before taking any action is a good idea. Sometimes it may seem like the employer is in the wrong, but there is no violation. Other times, the offense is minor and creating a lawsuit won’t solve anything. A lawyer’s job is to listen to the details and determine if a case is egregious enough to move forward. In the event that the lawyer feels that there is a clear rights violation, the lawyer can start taking steps to fix the problem before taking it to court. If court is necessary, the lawyer can move the case forward at the appropriate time.
